If you are the victim of false accusations of child abuse, feel free to contact me at any time. As time goes on, I hope to be able to provide more information on legal defense, progess in certain areas, testimonies of others with like trials, and other references about VOCAL and other organizations fighting the illegal, immoral system that allows families to be destroyed with no reason. But, most of all, we need a support system just to get things off our chests. THIS IS THAT SUPPORT SYSTEM! Talk, ask questions, share–we have all been in the same predicament. We need each other.
What To Do If You Fall Victim To Child Abuse Laws
Everyone is vulnerable to false accusations of child abuse. One day you are decent family members, just going about your regular activities. The next day, Child Protection Services steps in and your lives are forever changed. There seems to be no rhyme nor reason who they pick on nor why. Following are just a few things to consider if this happens to you.
Get professional assistance immediately, both legal and psychological. Check references through VOCAL if there is time. You will be able to find names of competent lawyers through VOCAL.
Treat the accusation very seriously. You know it is not true but the powers that be will not believe you. Find the money to defend yourself properly.
Do not waive any rights or sign anything without legal counsel. Do not be intimidated by threats from social workers or prosecutors. These are to make you afraid. Seek legal counsel before you say anything.
Ask for support. Do not be ashamed of anything. You did nothing wrong. Do not isolate yourself. Talk with family members, friends, family doctors, VOCAL members. These people can and will help.
Write everything down. Do not omit a single detail. Do not trust your memory.
Keep a file of all documents. Do not overlook even a tiny detail in them.
Request through the courts an independent psychiatric evaluation of the so-called victim. Ask that it be performed immediately. You are entitled to this. Do not trust the evaluation of a court-appointed psychiatrist or psychologist.
Do not submit to a psychiatric/psychological evaluation for yourself before discussing this with your own legal counsel.
Do not expect any logical approach from child protection workers or prosecutors. No matter how rational your explanations are, expect bizarre interpretations to be drawn from your statements.
Record all interviews. Always have an attorney present when dealing with child protection agents.
Help your attorney gather information. Read literature, become involved with VOCAL.
Avoid plea bargains. It means guilty and could easily result in you never seeing your child again.
File appeals immediately when your consitutional rights are violated. The appeals process takes a lot of time so move with caution but with aggression.
Consult your attorney before making public statements that could damage your case.
